Suit: nursing home supervisor fired for reporting sexual assault of patient

A former Orland Park nursing home employee is suing her old employer, alleging she was wrongly fired for reporting to police in 2011 that a male co-worker sexually assaulted a 93-year-old patient.

Former night shift nursing supervisor Rosemary Braderic is seeking $30,000 compensation from Lexington Healthcare Center under Illinois’ whistle blower protection law, according to a suit filed Friday in Cook County Circuit Court.

After reporting the sexual assault, Braderic, of Country Club Hills, claims she drew the ire of her bosses, who felt the attack could portray the nursing home negatively, the suit alleges.

According to court filings, Braderic’s boss -- identified in the suit only as “Diana“ -- was upset police were called because “calling the police would lead to ‘bad publicity,’” the suit alleges.

Several months later Braderic, who had worked at the nursing home since 2002, was fired, the suit states.

Orland Park police could not be reached Friday night to verify the sexual assault was reported. Representatives of Lexington Healthcare Center of Orland Park, 14601 S. Humphrey Drive, also could not be reached for comment.

While Braderic did not witness the attack, she claims in the suit that a fellow nurse came to her on July 24, 2011, claiming she watched a male co-worker sexually assault the 93-year-old female patient.

In the court filing, Braderic, who was working as a supervisor on the night of the alleged attack, claims she verified the assault did occur before contacting Orland Park police.

Braderic, who was 63 when she was fired, is seeking compensation for wages and benefits lost when she was fired, the suit states.
